Sokoloff Lawyers is pleased to announce that on August 2nd, 2023, the Ontario Divisional Court released its decision in Kellerman-Bernard v. Unica Insurance Company.
Sokoloff Lawyers were successful in having the LAT’s decision overturned. The LAT erroneously held that a family member with significant emotional impairments as a result of a loved one’s accident was not able to seek a catastrophic impairment designation, despite being an ‘insured person’. In overturning the decision, the Court found that the LAT’s decision “increased …suffering and economic hardship’ for “…people with the most health care needs…”.
